The personal data and special categories of personal data you share with us are processed in accordance with the Personal Data Protection Law (KVKK), in a manner relevant, limited and proportionate to the purposes of our services and activities under medical legislation. Please also read the Patient Privacy Notice prepared for our patients.

Methods and Legal Bases for Collecting Your Personal Data

Your personal data may be collected verbally, in writing, through WhatsApp or electronically. When you complete a form in the contact section of our website, data relevant to that purpose is also collected.

Your personal data, including examination information, health data, photographs, treatment records, various written or oral agreements, petitions, interviews, business cards and documents obtained during litigation or enforcement proceedings, is processed according to the circumstances of the healthcare services provided. The domain and server provider may keep internet access logs, including IP addresses, timestamps and traffic information, under Law No. 5651. Our website does not use cookies relating to its operation and does not conduct profiling. Please also read our cookie policy, which explains how to disable cookies. The website was established to provide information about our address, contact details and areas of service.

Your personal data may be obtained by automated means, such as text messages, WhatsApp and similar correspondence, email, the internet, disks, CDs, DVDs, memory cards, telephones and similar electronic or internet-based tools, or by non-automated means, such as forms, contracts, notifications and decisions of judicial or administrative authorities.

Cooperation protocols under the KVKK are concluded with the private hospitals, laboratories, medical consumables suppliers and patient record database service providers with whom we coordinate. Unsolicited CVs sent for employment applications are not processed and are destroyed immediately.

The data processed includes identity and contact information, location information (addresses and door numbers are not requested), health data, images such as pre-operative and post-operative photographs, website visitor information, dates, hospital names, payment information, employment-related information and correspondence on platforms such as WhatsApp. The groups of data subjects include clients (patients), supplier representatives, supplier employees and accompanying persons. The legal bases for processing your personal data are:

• a) Processing being required by legislation for taxation and invoicing.
• b) Processing being necessary to fulfill our clinic’s legal obligations under healthcare legislation to maintain and retain records and share information with authorized authorities.
• c) Processing being necessary for the performance of a contract.
• d) Processing being necessary for the protection, exercise and establishment of our clinic’s rights and claims.
• e) Explicit consent or legitimate interests, where applicable.

Purposes of Processing Your Personal Data

Taking account of the principles in Article 4(2) of the KVKK and the activities provided for under healthcare legislation, your personal data is processed to enable you to benefit from our services and to comply with record-keeping, information retention, reporting, taxation, contractual and other legal obligations. Your data is retained for the periods specified by legislation or, where no period is prescribed, for a period proportionate to the purpose based on legitimate interests and explicit consent practices. Digital data is then irreversibly deleted and paper records are shredded. A data subject’s deletion request will be fulfilled immediately, provided that doing so is not contrary to legislation.

Retention periods are detailed in our personal data retention and destruction policy. In general, the periods are 10 years for contracts, 10 years for employment and social security law, 10 years for tax records and 15 years for occupational safety. Health records are retained for 30 years after the service ends, with legislation requiring a minimum of 20 years.

Transfer of Your Personal Data

As a matter of principle, your personal data is not transferred abroad. However, you should be aware that correspondence through email services such as Gmail, Yahoo or Hotmail, services provided from abroad such as WhatsApp or Telegram, and platforms such as Instagram or Facebook may result in your data circulating abroad, even unintentionally. Data belonging to foreign citizens or residents who contact us from abroad may need to be shared with them or with addresses abroad for overseas insurance or health tourism procedures. Such data is processed on the legal basis that the individual has made it public.

Because the patient records software, appointment system and programs used to store radiological images are provided from abroad, processing in this respect is carried out on the basis of your explicit consent.

In accordance with the purposes above, the KVKK and other legislation, your personal data may be transferred to institutions and organizations in Türkiye and, where provided for by applicable legislation, to regulatory and supervisory bodies, Provincial Directorates of Health, courts, public prosecutors, administrative authorities and other official bodies. Our general principle is not to share data unless necessary.

With your explicit consent and with respect for fundamental rights and freedoms, your pre-operative and post-operative photographs and radiological images may be shared for scientific purposes within academic communities in a manner that does not reveal your identity.

Your Rights as a Data Subject

Under Article 11 of the KVKK and other applicable legislation, you have the following rights:

• To learn whether your personal data is being processed.
• To request information if your personal data has been processed.
• To learn the purposes of processing and whether your data is used in accordance with those purposes.
• To learn which third parties receive your personal data in Türkiye or abroad.
• To request correction of incomplete or inaccurate personal data.
• To request deletion or destruction of your personal data under the conditions prescribed by data protection legislation.
• When requesting correction of incomplete or inaccurate data or deletion or destruction of your personal data, to request notification of these actions to third parties to whom the data has been transferred.
• To object to an adverse result arising from the analysis of your data exclusively by automated systems.
• To seek compensation for damage caused by unlawful processing of your personal data.

Procedures for Exercising Your Rights

As the person to whom the data relates, you may exercise the rights above by submitting a clear request explaining the right you wish to exercise, in writing or by other methods specified by the Personal Data Protection Board.

You may deliver your written request bearing your handwritten signature to the address above by post or by hand, or submit your request from the email account registered with us.

Your application must concern you and include your identity and address information. Identity verification will be limited to the information we already hold. If you apply on behalf of another person, you must provide a power of attorney containing specific authorization. No particular format is mandatory, but you may use the application form on our website. A clear description of your request will help us provide a clear response.
